1. Acceptance of Terms

By creating an account or using CogaGuard Copilot (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

CogaGuard Copilot is an AI-powered platform that scans websites for cognitive dark patterns, UX manipulation techniques, and ethical design violations. Results are provided for informational purposes and do not constitute legal advice.

3. Account Registration

• You must provide accurate and complete information when creating your account.
• You are responsible for maintaining the confidentiality of your password.
• You must be at least 18 years old to use the Service.
• One account per person or legal entity.

4. Credits and Payments

• New accounts receive free credits upon registration.
• Credits are consumed when performing scans. Credits are non-refundable once used.
• Purchased credit packages are non-refundable unless required by applicable law.
• Prices are displayed in EUR and include applicable VAT where required.
• Payments are processed securely by Stripe.

5. Acceptable Use

You agree not to use the Service to:

• Scan websites you do not own or have explicit permission to audit.
• Attempt to reverse-engineer, scrape, or overload the platform.
• Use scan results to harass, defame, or harm third parties.
• Circumvent usage limits or share account access.

6. Intellectual Property

All content, trademarks, and software of CogaGuard Copilot are the property of their respective owners. Scan reports generated by the Service may be used by you for your own business purposes. You may not resell or redistribute reports without written permission.

7. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind. We do not guarantee that scan results are complete, error-free, or suitable for any particular purpose. AI analysis may produce false positives or false negatives.

8. Limitation of Liability

To the maximum extent permitted by law, CogaGuard shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount you paid in the 30 days prior to the claim.

9. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting privacy@cogaguard.com.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email.

11. Governing Law

These Terms are governed by Italian law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
